Capacity and minors

The seller is a French sole trader and the contract is governed by French law. In the event of any discrepancy or difference of interpretation between the two versions, the French version prevails.

This page sets out who may order on this site and on what terms a minor may benefit from a service.

Who may order

Ordering is restricted to persons who are of full age and legally capable, acting on their own behalf or on behalf of a business they represent. By confirming an order you declare that you meet those conditions.

An order placed by a minor without the agreement of their legal representative is cancelled as soon as it is discovered and refunded in full within 14 days, without being performed.

Services for the benefit of a minor

the order is placed and paid for by the legal representative, who is the sole contracting party and the sole addressee of the invoice;
the legal representative gives the first name and age of the beneficiary at the time of the order;
for a beneficiary under 16, the legal representative must be present or reachable throughout any remote session;
no account, no personal area and no direct correspondence is opened in the minor's name.

Minors' personal data

No data is collected directly from a minor. The only information processed is that provided by the legal representative, limited to what is necessary for performance: first name, age, and where relevant the details useful to running the service. It is deleted on the same timescales as other order data — see the privacy policy.

no profiling, no targeted advertising, no advertising tracker: this site carries none for anyone;
no photograph and no audio or video recording of a minor is made or kept;
no data concerning a minor is passed to a third party, save where the law requires it.

Right of withdrawal

The legal representative exercises, on the same terms as any consumer, the 14-day right of withdrawal described on the Withdrawal and refunds page.

Reporting

If you believe a minor has placed an order without permission, write to contact@jacekmucha.fr: the order is cancelled and refunded without argument, and without the service having been performed.
